The Trump administration has intervened in the copyright battle between OpenAI and The New York Times, filing a court letter on Tuesday that argues training AI models on copyrighted material qualifies as fair use under U.S. law.

In the letter, the U.S. Department of Justice stated that the government has a “strong interest” in the case because it affects whether the country’s AI industry can maintain global leadership. The administration contended that The New York Times’ interpretation of fair use is “inconsistent” with current copyright law and that restricting AI training could hinder “creative and scientific progress while hindering American prosperity and economic mobility.” It also argued that large language models are “extraordinarily transformative” and do not significantly compete with the original works they are trained on .

The Justice Department emphasized that there is a legal distinction between copying content for training and the output generated by AI models, which “often if not always lack substantial similarity” to the original works. It compared AI training to human writers studying others’ work, citing Joan Didion’s practice of typing out Ernest Hemingway’s stories to learn writing techniques .

The New York Times criticized the administration’s position, stating it was “siding with a handful of trillion-dollar AI companies at the expense of the countless American creators whose work they stole.” Graham James, a spokesperson for the paper, said in an emailed statement that “AI and creators can thrive — AI companies simply need to pay fairly for the content that makes their products possible, as copyright law requires” .
