
TikTok and its parent company ByteDance agreed on Friday to pay $400 million to settle a U.S. Department of Justice lawsuit alleging violations of children’s online privacy laws, according to multiple official announcements .
The lawsuit, filed by the Justice Department in 2024 under the Biden administration, accused TikTok of violating the Children’s Online Privacy Protection Act (COPPA) by collecting and retaining personal data from users under 13 without parental notice or consent. The settlement requires TikTok to pay $300 million immediately, with an additional $100 million due once a 2019 Federal Trade Commission consent decree involving TikTok’s predecessor, Musical.ly, is lifted .
Deputy U.S. Attorney General Stanley E. Woodward Jr. stated in a release that the agreement prioritizes protecting children online and ensuring companies comply with legal obligations. “The priority of the Department is to ensure that children are protected online and that companies to which their personal information is entrusted comply with their legal obligations,” Woodward said .
The Justice Department noted that TikTok has since implemented changes to its privacy policies, including requiring users to provide a date of birth and deploying systems to verify ages, deleting tens of thousands of underage accounts. The case stemmed from a Federal Trade Commission investigation that found TikTok had allowed children to create accounts and interact with adults on the platform since 2019 .
The settlement coincides with broader legal scrutiny of social media platforms’ handling of minors’ data. Twenty-nine U.S. states have filed lawsuits against Meta under COPPA, with a jury trial beginning this week in Oakland, California. Previous COPPA settlements include Google’s YouTube paying $170 million in 2019 and Epic Games paying $275 million in 2022 .
TikTok did not immediately comment on the settlement. The agreement does not constitute an admission of guilt, according to the Justice Department .
