New York City Mayor Zohran Mamdani announced on Tuesday that the city lacks the legal authority to arrest Israeli Prime Minister Benjamin Netanyahu, despite an international arrest warrant issued by the International Criminal Court (ICC). In a video statement posted on the platform X, Mamdani said that a legal review by his administration concluded that New York City does not have the independent legal authority to enforce the ICC warrant.

Mamdani, who has previously called Netanyahu a war criminal, urged the federal government to take action. "The US government has the authority to enforce this warrant, and I call on them to join the International Criminal Court and enforce this arrest warrant," Mamdani said in the video. He added that Netanyahu is not welcome in New York City, stating, "Benjamin Netanyahu is not welcome in New York City, nor is any other fugitive alleged war criminal."

The ICC issued an arrest warrant for Netanyahu in November 2024 over allegations of war crimes in the Gaza Strip. Netanyahu has denied the allegations. The US government, under President Donald Trump, does not recognize the ICC and has stated that Netanyahu will not be arrested while in the United States.

Netanyahu is expected to visit New York City in September for the UN General Assembly. During his mayoral campaign, Mamdani had promised to arrest Netanyahu if elected, but later stated that his administration was reviewing the legal possibilities.

In his video statement, Mamdani also referenced the casualty figures from the Gaza Strip, citing numbers from the Hamas-controlled health ministry. "Netanyahu is responsible for the deaths of more than 73,000 people and the mutilation of tens of thousands of children," Mamdani said.

The US government has not responded to Mamdani's call to enforce the ICC warrant. President Trump has previously stated that Netanyahu "will not be arrested, in any way, shape, or form, while in the United States of America."
