Media groups sue Trump over paid access to Truth Social posts in New York court

Two American media organizations, The Intercept and the Freedom of the Press Foundation, filed a federal lawsuit against U.S. President Donald Trump on Wednesday in a New York court. The lawsuit challenges Truth API, a subscription service by Trump Media & Technology Group that sells early access to posts from prominent Truth Social accounts, including Trump’s, for up to $100,000 per month.
The complaint alleges the service violates the First Amendment by restricting equal access to public announcements and the Fifth Amendment by charging arbitrary fees for government information. It names Trump in his official capacity, along with White House aide Natalie Harp and Deputy Chief of Staff Daniel Scavino. “This scheme is profoundly corrupt,” the filing states. “The president stands to gain financially by giving ‘market-moving’ government information to those who are willing and able to pay his personal company.”
Truth API, launched on Aug. 1, offers real-time access to posts from Trump and other high-profile accounts, with more than 10 subscribers already enrolled as of an Aug. 10 earnings call. The service markets itself as a B2B data feed delivering posts within milliseconds, primarily targeting high-speed trading firms and financial market participants. Trump holds the largest stake in Trump Media & Technology Group, valued at roughly $1 billion, down from about $4 billion when placed in a trust in early 2025.
Critics note Trump routinely uses Truth Social to announce policy decisions, such as tariffs or military actions, which can influence financial markets. The Intercept’s editor-in-chief, Ben Muessig, stated, “Trump is trying to enrich himself by privatizing government information that he has no right to sell” .
The lawsuit argues the paid access model creates a system where wealthy actors gain an informational advantage over the public. Trump Media & Technology Group has rejected the allegations, defending the service as a legitimate commercial offering .
