New York City Mayor Zohran Mamdani has called on the U.S. federal government to arrest Israeli Prime Minister Benjamin Netanyahu if he visits the United States for the UN General Assembly in September.
In a video message posted on social media on Tuesday, Mamdani acknowledged that New York City does not have the authority to enforce an International Criminal Court (ICC) arrest warrant against Netanyahu. "The federal government, however, does, and I call on them to join the ICC and execute this warrant," Mamdani said.
The ICC issued arrest warrants for Netanyahu and former Israeli Defense Minister Joav Galant in November 2024 over allegations of war crimes and crimes against humanity in Gaza. However, the U.S. is not a signatory to the ICC, meaning it is not obligated to enforce the court's arrest warrants.
As a head of state, Netanyahu enjoys immunity in the U.S. and cannot be arrested by local authorities. US President Donald Trump has stated that Netanyahu will not be arrested in the U.S. "Netanjahu werde in den USA ganz sicher nicht verhaftet," Trump said on Monday, according to a statement.
Mamdani referred to Netanyahu as a "war criminal" and accused him of being responsible for the deaths of more than 73,000 people in Gaza, targeting hospitals, and blocking food and humanitarian aid from reaching people in need. "Benjamin Netanyahu is not welcome in New York City, nor is any other war criminal at large," Mamdani stressed.
The ICC warrant against Netanyahu remains unenforced. The U.S. is not obligated to enforce the warrant due to its non-signatory status to the ICC.
