Trump signs orders to restrict birthright citizenship and curb birth tourism
President Donald Trump signed two executive orders on Thursday targeting birthright citizenship and so-called birth tourism, according to multiple reports.
The first order expands the categories of foreign nationals whose children born in the United States would not automatically receive U.S. citizenship. This includes parents who are members of foreign terrorist organizations, employees of foreign governments, or individuals who obtained entry through fraudulent means. It also applies to births in U.S. territories where citizenship is not conferred by federal law, such as Puerto Rico, Guam, or the U.S. Virgin Islands .
The second order aims to crack down on birth tourism, the practice of traveling to the U.S. to give birth solely to secure citizenship for the child. Under the new rules, U.S. authorities may deny visas or entry to individuals suspected of engaging in birth tourism .
Trump, who has long opposed birthright citizenship, called the Supreme Court’s June decision upholding the constitutional right “very unfortunate” and “unfair.” That ruling struck down his earlier attempt to end birthright citizenship for children of undocumented immigrants .
White House officials, including Deputy Chief of Staff Stephen Miller, stated that the measures target “malicious foreign actors” exploiting U.S. generosity. Miller cited cases where individuals entered the U.S. under false pretenses, such as claiming to visit Disneyland, while intending to give birth .
The Migration Policy Institute, a nonpartisan research group, estimates that between 22,000 and 26,000 children are born annually in the U.S. through birth tourism, far below Trump’s claim of “hundreds of thousands” .
The orders follow the Supreme Court’s 6-3 decision in June, which reaffirmed that children born in the U.S. automatically receive citizenship, regardless of their parents’ immigration status . Legal challenges to the new executive orders are expected.
